Terms of Service
This T.O.S will be separated into sections, I recommend that you read everything before buying a commission from me or if you get a character that has an art made by me.The T.O.S for designs will be separate.
Payment:
Payment can be through paypal or Ko-fi.On some occasions I will accept payment as DA points, check if this is available in the commission post you are interested in.Payment must be made before the start of the project, being the full amount.I will only accept payment in the middle or at the end if the buyer and I have agreed to it beforehand, however this is an exclusivity that I do not give to everyone. This exclusivity is only given to permanent buyers and people close to me or whom I trust.Payment split between two or more people is accepted as long as they all pay on the same day and cover transfer fees. (direct payments from a single person do not need to pay the transfer fee).In case of large orders or with multiple pieces, the possibility of a payment plan can be discussed:• I will only start the project(s) as soon as the first part of the value is delivered.
• I will give less w.i.ps, the only guaranteed w.i.p will be the initial one. To obtain multiple w.i.p, the amount paid must already be above half of the total amount.
• You will receive a completely blurred image with a watermark on top, as soon as the last payment is made you will receive the artwork in good quality.
- In case the payment is late, the art will also be late.
• If the last payment is not made within 1 month of the date on which it was agreed, the art will be in my possession, so I can do whatever I want with it."Unless I am notified in advance of the delay, in which case we can see another date for payment."-----------------------------------------------Refund:If the art has not yet been started, refunds will be allowed, you will receive 100% of the amount paid.In case the art has already been started and/or the first w.i.p has already been delivered, there is a chance that the refund will be refused or you will receive half of the total amount (Not including transfer fees).
• If refunded (50% not including transfer fees) the art will be in my possession, so I can reuse it for my personal projects or modify it to make it someone else's commission.
• You, customer, will lose any rights over the art and will not be able to use it, it is only guaranteed that the art will be modified so that it no longer looks like your character.If the project is a sketch, icon, headshot or pixel art (small only), refunds will not be accepted at any time unless I haven't started yet or I decide I can't complete the project and decide to cancel the commission.In case the colors, lineart, shading or background are already almost complete or complete the refund will be refused. (Remembering that only 1 of these items is needed for this part to become active).If I go more than 7 months without completing the commission (from the first w.i.p that starts counting) you can ask for a 50% refund. In that case you are guaranteed that the refund will be accepted and made regardless of how complete the project is.-----------------------------------------------Process:After the first payment or full payment, the artwork will begin.The first w.i.p is always guaranteed, in it you must inform if there is any error or if you would like something to be changed.
• 1 big change and 3 small changes are guaranteed.
• If you want to make a second big change you will have to pay a fee.The status of all commissions at the moment will be organized 1 time every 1-2 weeks.
• If you want extra or exclusive w.i.p (outside the scheduled date) you must inform me in advance during the commission purchase.
• Extra w.i.p are limited however, please don't ask for an update every day.
• You will not be refused if you ask for extra w.i.p after purchase but it is recommended to order in advance.Sometimes the w.i.p closest to being complete will have a watermark in the middle of the screen.
• This will not be removed, it is possible to see the image even with the watermark.Small changes during lineart, or finalization depending on the piece, are accepted, but have a limit of 2.
• If you want more than two, you will have to pay a fee for each extra change.
• Big changes are not accepted.After the piece is complete no changes will be accepted unless I have made a mistake. (Like some color or detail I forgot to add)
• But of course, in case I "forget" an accessory, it will be checked in the commission request if this item was mentioned, if it wasn't mentioned, I won't have to add it.-----------------------------------------------Your rights:The commission can be private, meaning I won't post it or if I get permission to post your name will be listed as "anonymous buyer".The purchased art can only be used for personal use: character gallery, profile decoration, icons, banners, pagedolls or reposted (with my permission and with credits) on your profile.
• Physical items such as key chains, stickers, posters and others can be made as long as it is kept just for you and is not distributed/sold.Commercial use must be discussed first.
• An additional fee will be required to obtain commercial use rights.NFT and AI will be denied, my art must never be used in either.You can ask that I delete the piece from my gallery/portfolio, however, if the commission wasn't "private" from the beginning, I will perhaps ask for a reason for this request.
My rights:I can use art to promote myself.
• You will be mentioned as buyer and owner of the character.
I can add it to my portfolio/commissions page as an example of art.
• However, if the commission is private, these two items will only be allowed if I get permission from the buyer.If I make a speedpaint of the piece, I will ask if I can post it, if the buyer says no, the video will be deleted.My art must not be modified without my authorization, therefore:
• If there are any errors in the art, I can fix it at no extra cost.
• If the character has been redesigned, I can modify the art to update it according to the new design, but if the change is too big, it will be refused. (For this change a fee will be added depending on how much I have to redo it)
• In the case of complex pieces this may be refused due to the work it would take to change the details.
• Colored or colorless/white and black sketches should not be finished, if you want the piece to be complete I can do a lower price to finish it.
• Paying another artist to finish the art is not allowed under any circumstances.
• Small color changes (on the entire image) will be accepted as long as you ask beforehand.
• Turning my art into an animation will not be accepted.
• Bases can be modified to the customer's taste, however this does not include "YCH".
• My art must not be used for "study" or traced under any circumstances.
• Cropping or resizing the image for your personal use is allowed and you don't need to ask for permission.-----------------------------------------------By obtaining an art from me, whether exclusive (commission), YCH, through order, raffle or as a gift, you will be agreeing to these terms.My only obligation is to leave the T.O.S visible so that the customer can see it, in case the customer does not read the T.O.S, they will still have to obey the rules.It is the customer's responsibility to read the T.O.S.Some information may be removed, added or modified.
• If the change is large, a notice will be made informing what the change was.
• In the case of small changes that do not affect the client, there will be no notification.
